Judge Grants Jay-Z’s Request to File Motion to Dismiss Assault Lawsuit

Shawn “Jay-Z” Carter just won a small victory in court.

A federal judge on Thursday, Jan. 2, granted a request allowing an attorney for the hip-hop mogul to file a motion to dismiss an amended civil lawsuit alleging the mogul raped a “Jane Doe” accuser when she was 13-years-old.

However, the decision by Judge Analisa Torres does not mean the case will be dismissed.

Instead, the judge gave Jay-Z’s attorney, Alex Spiro, until Feb. 6 to submit a motion to dismiss the case.

The accuser’s attorney, Tony Buzbee, then has until Feb. 28 to file opposing documents.

Buzbee previously submitted a letter to the court opposing Jay-Z’s request to dismiss the case.

This latest decision by Judge Torres comes after she handed down a decision on Dec. 26, saying the accuser can remain anonymous, for now.

In that same decision, the judge criticized Spiro for wasting the court’s time with his “relentless filing of combative motions containing inflammatory language.”

The judge is overseeing the accuser’s amended lawsuit, which was filed on Dec. 8, when the unidentified Alabama woman alleged Jay-Z and Sean “Diddy” Combs took turns assaulting her at an MTV Video Music Awards afterparty in 2000, as an unnamed female celebrity watched.

Both Jay-Z and Diddy vehemently denied the allegations in the lawsuit.

The woman is now 38-years-old. On Dec. 13, NBC aired an interview with the accuser and noted that there were “inconsistencies” in her account of the alleged rape.

The woman said she has autism and can’t recall some details from that night in 2000.

“I have made some mistakes,” she said about her recollection of the alleged assault.

In a filing on Dec. 18, Jay-Z’s legal team asked the court to dismiss the rapper from the lawsuit, citing the woman’s inconsistencies.
